ACCEPTABLE USE POLICY
What we will make, and what we won’t.
SparkMyName generates names, logos, photos and marketing art with AI. That power comes with a short list of things we will not do, because they would put you, the people in the pictures, or other businesses at legal risk. This policy is part of our Terms of Service, and every request to our Art Department is checked against it automatically before an image is made. Last updated September 17, 2026.
1. No real, identifiable people
We do not generate images of real people — celebrities, athletes, politicians, influencers, public figures living or dead, your competitor, your neighbor, your ex, or anyone else who has not agreed to appear. That includes “looks like” requests, face swaps, deepfakes and any use of a real person’s name to steer the picture. Right-of-publicity and privacy laws in most U.S. states and many countries make commercial use of a person’s likeness without consent unlawful, and a generated image is no exception.
What to do instead: describe the kind of person you want (“a barista in her thirties, warm smile, denim apron”). Our engines draw people who do not exist.
2. No other company’s names, logos, characters or trade dress
We do not copy, imitate or riff on third-party trademarks, logos, mascots, fictional characters, franchises, packaging or distinctive product designs — whether you name them (“the Nike swoosh”, “Mickey Mouse”, “like the Starbucks logo”) or describe them closely enough that the result would be recognizable. Using them would expose your business to trademark and copyright claims, and we will not build a brand on that footing.
Ordinary words are fine. A bakery can be “Mario’s”, a gym can be named after Thor, and a phone-repair shop can say it fixes phones. The line is imitation of a specific mark or character.
What to do instead: describe the feeling in your own words (“a friendly cartoon fox mascot in our green, thick outlines, retro”). The result is yours.
3. No unlawful, dangerous or deceptive content
- Sexual content of any kind, and anything that sexualizes a minor (this is illegal and is declined without exception).
- Graphic violence, gore, or content that promotes harming people.
- Hate symbols and content that attacks people for who they are.
- Illegal weapons or controlled substances for sale. Licensed businesses are welcome — a gun shop or a dispensary can describe the store; we will not depict restricted items for sale where that is unlawful.
- Counterfeit or replica goods.
- Fake official documents: IDs, passports, licenses, diplomas, badges, prescriptions, tickets, receipts, bank paperwork — including “novelty” versions.
- Realistic currency, printable money, and scannable coupons or gift cards.
- Government seals, badges and “approved” marks (FDA, USDA, IRS, police and the like). Those belong to the agency.
- Unsubstantiated health or financial claims (“cures cancer”, “FDA-approved”, “guaranteed returns”) — these are regulated claims and we will not print them into a design.
- Fake reviews, fake press mentions, fake awards, phishing pages, or anything else built to mislead customers.
4. How the screen works
Before any words you type reach an image engine, they are matched against the categories above. If a request matches, no image is made, no credit is used, and you see a plain explanation with a suggestion for how to rephrase. The screen is a list of words and patterns, not a judgement about you; it will occasionally stop an innocent request (write to us and we will help), and it cannot catch every clever phrasing, which is why this policy applies to what you meant, not only to what the screen caught. We keep a count of declined requests and the first 80 characters of each for 30 days, unlinked from your account, to improve the list.
5. Your side of it
- Use the materials for your own business. Do not resell generated images as stock, as NFTs, or as a service.
- Label AI-generated imagery where the platform or the law requires it, and leave the content-credential metadata in the files. See Content Credentials.
- Do not present a generated image as a real photograph of a real person, place or product when that would mislead a customer.
- Have an attorney check a name and a logo before you invest in them. Our trademark screen is a preliminary check, not clearance.
- Do not attempt to get around the screen. Repeated attempts to generate prohibited content may result in closure of your Studio without refund.
6. If something slipped through
If a generated image turns out to resemble a real person, a real mark or a real character, do not use it — write to support@sparkmyname.com with the file name and we will replace it free. If you are the person or the rights holder, our takedown page explains how to reach us and what we do.
