The 2026 season at a glance
- Holiday spending is still growing. The National Retail Federation forecasts November and December retail sales up 4.2% over 2025, to $1.013 trillion, and expects retailers to hire 325,000 to 375,000 seasonal workers (NRF, Oct 15, 2026).
- Small Business Saturday is November 28, 2026 (SBA). In 2025, 62.7 million people shopped in person on Small Business Saturday, up from 61.1 million in 2024 (SBA, citing NRF). Make your post with the free Small Business Saturday post maker.
- Shipping cut-offs: for delivery before December 25 in the lower 48 states, USPS recommends sending USPS Ground Advantage and First-Class Mail by Thursday, December 17, Priority Mail by Friday, December 18, and Priority Mail Express by Saturday, December 19 (USPS).

Should the name say Christmas? Only if you’ll close in January. “Bough and Basket” still works for Valentine’s Day, Mother’s Day and company gifts. A name built on Christmas or Santa sounds odd in March, and you’d have to start over. Spark’s free name generator and free slogan generator help with both.
How to pick a holiday name that works
- Say it out loud, then read it from across the aisle. Market shoppers see your banner from 10 feet away and hear your name from a friend. Two or three short words beat a clever sentence.
- Make it easy to find after the market. Shoppers look you up on their phone later. A name they can spell after hearing it once is a name they can find.
- Check your state’s records. “Most states don’t allow you to register a name that’s already been registered by someone else” (SBA). Spark’s official business name search for all 50 states takes you to the right search.
- Register a DBA if you trade under another name. The SBA says most states require it, but “registering your DBA name doesn’t provide legal protection by itself” (SBA).
- Search federal trademarks. A trademark protects a name at the national level (SBA). Search the USPTO trademark database and run Spark’s free name check for the .com and a first trademark screen.
Holiday pop-up shops: what to check first
- A sales tax permit for the pop-up. In California, anyone selling at one location for under 90 days is a temporary seller and must hold a temporary seller’s permit. It’s free, and you can apply up to 90 days before you open. If you already have a seller’s permit, you register a sub-permit for each temporary location instead (CDTFA).
- Texas works differently. Sellers at fairs, festivals, markets and shows need a Texas sales and use tax permit if they sell taxable items, and “there is no fee to apply for a permit” (Texas Comptroller).
- Local licenses. The licenses you need “will depend on your business activities and business location”, and the SBA suggests starting with your Secretary of State’s website (SBA). Ask the landlord or mall about their own rules for short leases too.
Christmas and holiday markets: booth basics
- Ask the organizer how sales tax works. In Texas, event organizers must collect and remit sales tax on sales made at their event by sellers who don’t have an active permit (Texas Comptroller).
- Selling food you made at home? Nearly every state has a cottage food law, but “there is much variation in the approaches taken by the states” (National Agricultural Law Center). Texas, for example, raised its cottage food limit to $150,000 in annual gross income, allows most foods except meat, poultry, seafood and a few others, and requires a label that says “THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION” along with your name, address or registration number and allergens (Texas DSHS).
- Your sign is your name. A booth banner, a table card with a QR code and the same name on your Instagram profile help shoppers come back after the market closes. The free review QR code cards and business card maker can help.
Gift basket businesses: three rules people miss
1. Alcohol needs its own license
Wine in a basket is still an alcohol sale. Connecticut, for example, has a gift basket retailer permit: up to four bottles of wine or mead, or 72 ounces of beer or cider, per basket, bought from a package store or manufacturer, for $300 a year or $200 for six months (Connecticut DCP). Other states have different rules, so ask your state’s liquor agency before you add a bottle.
2. Homemade treats follow cottage food rules
In Texas, a cottage food operator may sell online only when the operator, an employee or a household member delivers the food in person, so mailing homemade cookies across the country isn’t covered (Texas DSHS). Check your own state’s law before you ship food you made at home.
3. Ship before the cut-off
For delivery by December 25 in the lower 48 states, USPS recommends December 17 for Ground Advantage, December 18 for Priority Mail and December 19 for Priority Mail Express. Actual delivery dates can vary (USPS). Put your own “last order” date a few days earlier.
Questions people ask
What's a good name for a holiday pop-up shop?
One that's short, easy to say and easy to find on Instagram after someone sees it once. Names like Tinsel Corner or Frostfall Pop Shop sound seasonal without boxing you in. Check the .com, your state's business records and the USPTO trademark database before you print anything.
Should my holiday business name include the word Christmas?
Only if you'll close in January. A name like Bough and Basket or Ribbon and Crate keeps working for Valentine's Day, Mother's Day and company gifts; a name built on Christmas doesn't.
Do I need a permit to sell at a holiday market?
Usually you need a sales tax permit if you sell taxable items. California requires a temporary seller's permit to sell at one location for 90 days or less, and it is free. Texas requires a sales and use tax permit for sellers at fairs, festivals, markets and shows, with no fee to apply. Your city or county may require other licenses.
Can I put wine in my gift baskets?
Not without the right license. Connecticut, for example, has a gift basket retailer permit that allows up to four bottles of wine or mead, or 72 ounces of beer or cider, per basket, for $300 a year. Rules differ by state, so ask your state's liquor agency first.
When should I ship holiday gift baskets?
For delivery before December 25 in the lower 48 states, USPS recommends sending USPS Ground Advantage and First-Class Mail by Thursday, December 17, Priority Mail by Friday, December 18, and Priority Mail Express by Saturday, December 19, 2026.
